Mother injured on holiday to receive £3.2 million compensation

Scott Rigby, Senior Associate in the firm's Personal Injury department, has settled the claim for a young mother who was injured on the first day of her holiday.

The client had just arrived at her holiday accommodation in France when a driver accidentally lost control of their car, which knocked over the client, her partner and their 3-year old child.

As a result of this accident the client was left with a permanent spinal cord injury, which means that she will be wheelchair dependant for the rest of her life.

The client will receive £3,200,000 by way of an immediate lump sum payment after Scott completed negotiations with the defendant's legal team 3 weeks before trial.

Under the terms of the settlement, the client is also entitled to provisional damages. This means that if the client suffers from syringomyelia in the future, a recognised condition affecting those who have suffered a spinal cord injury, she will be able to return to court, at a later date, to seek an additional amount of damages to compensate her for any increased incapacity the syrinx may cause her to suffer.

Scott Rigby, who is experienced in handling catastrophic injury claims where accidents have occurred overseas, was able to advise the client regarding recent changes in European Law which meant that she was able to pursue her claim in the English courts and rely upon English Law, rather than French Law, to obtain the highest possible amount of compensation in order to meet her future needs.

At the same time as settling the client's claim for compensation, Scott was also able to negotiate a settlement of her costs, which means that the client will receive all of her compensation.
